SOCIAL SECURITY DISABILITY LAWYERS
The attorneys at Lunetto & Hegel are dedicated advocates for individuals who are entitled to Social Security disability benefits. Unfortunately, SSD benefits are often denied to people who have legitimate disability claims. As a result, many individuals who apply for benefits become discouraged or intimidated, so they simply give up their case, even though they’re genuinely entitled to their benefits.
At Lunetto & Hegel, we do not let the system intimidate our clients; we are aggressive and highly experienced Social Security advocates, and we’re proud of the fact that we win a very high percentage of cases for our clients.
Who Is Eligible for Social Security Disability?
If you work long enough at a job that is covered under the provisions of the Social Security Act, and you become disabled, you are probably eligible for SSD benefits. According to the U.S. Social Security Administration, a “disability” can be physical or emotional or a combination of the two. In order to be granted SSD benefits, you must have a disability severe enough to keep you from working in any regular paying job for at least 12 consecutive months.
The test for SSD benefits is not whether you can go back to a job you have lost - it’s whether you are physically and emotionally capable of doing a job five days per week and eight hours per day.
The Disability Must Be Documented
Perhaps most importantly, to obtain SSD benefits, you must have a physician state that you are disabled, and he or she should support this statement with clinical findings and/or laboratory results such as:
However, many genuine disabilities are difficult to diagnose by objective testing. In such cases, it’s up to us as your advocates to present your doctor’s reports properly and to convince the Social Security Administration that you deserve benefits. We know how to present your case to its best advantage before an administrative law judge and at the appeal stages.
Disabilities That Merit SSD Benefits
There are many disabilities that may qualify for Social Security disability benefits, but some of the physical and mental conditions that often qualify for benefits include:
