In September 2006, Plaintiffs' decedent husband was riding as a passenger in an automobile driven by defendant's decedent who was also plaintiffs brother. Both men died when their automobile collided with a truck. Plaintiffs' decedent estate by and through his wife sued defendant brother's estate for motor vehicle negligence.Plaintiff wife contended that defendant decedent brother fell asleep while driving, and hit an oncoming truck head-on. Defendant decedent brother was the sole cause of the collision.
Plaintiff wife sued for loss of consortium over the death of her husband.
DAMAGES: Plaintiff wife claimed loss of comfort, care and society.
RESULT: Prior to trial the parties settled for the insurance policy limits of $1,500,000.
